By accessing or using SnarkyZi (the "Service"), you agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree with any part of these Terms, you must not use the Service.

SnarkyZi is operated by Zi AI Works XX ("we," "us," or "our").

Your use of the Service is also subject to our Privacy Policy and Cookie Policy, which describe how personal data and cookies are collected and used.

2. About the Service

SnarkyZi is an AI-powered conversational assistant provided through https://snarkyz.com and operated by Zi AI Works XX. The Service is intended for entertainment, inspiration, and casual interaction only.

Some features may provide one-way or non-interactive experiences (for example, rituals) that are meant to be received rather than used for conversation.

3. No Professional Advice

The Service does not provide medical, legal, psychological, psychiatric, therapeutic, financial, or other professional advice. Content generated by SnarkyZi is for informational and entertainment purposes only and should not be relied upon as a substitute for advice from a qualified professional.

4. Mental Health and Crisis Disclaimer

SnarkyZi is not a mental health professional, therapist, counselor, or crisis support service. The Service is not designed to assist with emergencies, including situations involving self-harm, suicidal thoughts, violence, or severe emotional or psychological distress.

If you are experiencing thoughts of self-harm, thoughts of harming others, or are in an emotional crisis, you should immediately seek help from a qualified professional or contact your local emergency services or a suicide prevention hotline. Do not rely on SnarkyZi for such situations.

The Service does not encourage or endorse harmful, violent, or self-destructive behavior.

5. Artificial Intelligence Limitations

SnarkyZi generates responses using artificial intelligence. AI-generated content may be inaccurate, incomplete, misleading, offensive, or contextually inappropriate. Responses are generated automatically and do not reflect the views, opinions, or intentions of Zi AI Works XX.

You acknowledge that AI-generated content should not be interpreted as factual, instructional, authoritative, or as a directive to take any specific action.

AI-generated content may be fictional, satirical, exaggerated, or stylistic in nature and should not be interpreted as factual guidance or instructions.

6. User Responsibility

You are solely responsible for your actions, decisions, and behavior resulting from your use of the Service. Any reliance on AI-generated content is at your own discretion and risk.

Zi AI Works XX shall not be liable for any outcomes, damages, losses, or injuries arising from your interpretation of or reliance on content generated by the Service.

7. Non-Reliance

You expressly acknowledge and agree that you do not rely on the Service or any AI-generated content, in whole or in part, as the sole or primary basis for making decisions that may affect your health, finances, legal rights, employment, personal relationships, or safety. Any use of the Service is at your own risk.

8. User Conduct

You agree not to use the Service for any unlawful, abusive, or harmful purpose. You may not use the Service to generate, promote, or distribute illegal, dangerous, discriminatory, intentionally misleading, or harmful content, including content that encourages or justifies violence or self-harm.

8A. Automated Moderation and Session Control

SnarkyZi uses automated systems to detect and prevent unsafe, abusive, or otherwise prohibited use of the Service. These systems may analyze interactions for purposes of safety, compliance, and abuse prevention.

If potentially unsafe or prohibited use is detected, access to the Service may be limited, interrupted, or temporarily disabled at the session level, with or without prior notice. Such measures may be applied automatically and without human review.

Repeated session interruptions or access limitations associated with a user may, at SnarkyZi’s discretion, result in longer access restrictions, temporary suspension, or permanent limitation of that user’s access to the Service or certain features.

Moderation and enforcement actions are primarily automated. SnarkyZi does not provide continuous human monitoring of interactions and is not obligated to manually review or intervene in individual sessions.

SnarkyZi is not required to provide explanations, warnings, or justifications for moderation decisions, session interruptions, or access limitations. Moderation mechanisms and enforcement measures may be updated or modified over time.

9. Service Availability and Changes

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We do not guarantee that the Service will be available at all times or that any specific features will remain unchanged. Such changes or actions may be carried out automatically or manually.

10. Account Suspension and Termination

We reserve the right to suspend or terminate access to the Service or any associated account, with or without notice, if we reasonably believe that you have violated these Terms, misused the Service, or engaged in behavior that may cause harm to yourself, others, or the Service.

11. Intellectual Property

All branding, logos, designs, text, and other content associated with SnarkyZi are the property of Zi AI Works XX and may not be copied, reproduced, distributed, or reused without express written permission.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We make no guarantees regarding the accuracy, reliability, availability, or suitability of the Service or any AI-generated content.

The Service may rely on or integrate third-party services, platforms, tools, or software. Zi AI Works XX is not responsible for the availability, accuracy, security, or performance of any third-party services and shall not be liable for issues arising from their use.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Zi AI Works XX shall not be liable for any direct or indirect damages, including but not limited to incidental, consequential, special, exemplary, or punitive damages, emotional distress, personal injury (to the extent permitted by applicable law), loss of data, or loss of profits, arising out of or related to your use of the Service or reliance on AI-generated content.

To the maximum extent permitted by applicable law, the total aggregate liability of Zi AI Works XX arising out of or relating to the Service shall not exceed the amount paid by you to use the Service in the three (3) months preceding the event giving rise to the claim, or fifty euros (€50), whichever is greater.

14. License to Use AI-Generated Content

Subject to these Terms, you are granted a limited, non-exclusive, non-transferable license to use AI-generated content provided by the Service for personal, non-commercial purposes. You remain solely responsible for ensuring that any use of such content complies with applicable laws and does not infringe the rights of third parties.

15. Payments, Delivery, and Refunds

Certain features of the Service may be offered as paid message packages or other digital content. Prices and available packages may change from time to time.

Purchases are delivered immediately by adding messages to your account. By completing a purchase, you expressly consent to immediate delivery of digital content and acknowledge, as explicitly confirmed during checkout, that you waive any statutory right of withdrawal once the content is made available, to the maximum extent permitted by applicable law.

All purchases are final and non-refundable, including for unused messages, except where required by applicable law. Refunds may be granted at Zi AI Works XX’s discretion in cases of duplicate charges, unauthorized transactions, or technical errors that prevent access to purchased content.

16. Indemnification

You agree to indemnify and hold harmless Zi AI Works XX from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any applicable law or third-party rights.

17. Age Requirement

The Service is intended for users aged 18 and older. By using SnarkyZi, you confirm that you meet this requirement.

18. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes are made constitutes acceptance of the revised Terms. The "Last updated" date above reflects the most recent version.

19. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Estonia, without regard to its conflict-of-law principles. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the Republic of Estonia.

20. Severability and Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms constitute the entire agreement between you and Zi AI Works XX regarding the Service.
